These Terms & Conditions (“Terms”) govern access to and use of 909Cyber Inc.’s (“909Cyber”, “we”, “us”) 909Shield platform and services (the “Service”). The Service is a security and trust layer for hiring and other scenarios to validate the user identity.  It can verify the identity of humans, orchestrate background screening, and analyze interview sessions for fraud and integrity. By creating an account, integrating our API, or beginning a verification session, you agree to be bound by these Terms.

1. Definitions

  • “Client” (including “you”, “your”) means a company or its authorized users that use the Service to verify candidates.
  • “User” means an individual who is invited to complete a verification session.
  • “Portable Identity” means a user’s Verification Results that can be saved to verify that user for future applications for employment.
  • “Session” means a hosted verification flow initiated by a Client and completed by a user.
  • “Trust Score” means the automated risk indicator (0–100) and component signals produced by the Service.
  • “Verification Results” means identity, environment, background, and behavioral outputs of a Session, including the Trust Score.

2. The Service

909Shield is a software-as-a-service platform using a hosted session model: the Client initializes a Session and the user is redirected to a secure 909Shield environment for identity verification, optional background screening, and interview-integrity analysis. Through analysis of biometrics, environment, background, and behavior of a user, the Service produces Verification Results and a Trust Score. Biometrics of users are retained only as long as necessary to generate the Verification Results and Trust Score, but are not included in the Verification Results or the Trust Score. The Service provides risk signals and verification tooling; it is not a generative content tool, and it does not make employment, lending, housing, or other decisions about any individual. Client understands and agrees that Client is responsible for all such decisions, and that the Service is merely a tool to be used in those decisions, and that the Trust Score is based on the information provided and is not guaranteed to be 100% accurate.

3. Accounts and Eligibility

Users of the Service must be at least 18 years old. Clients are responsible for the accuracy of their account information, for safeguarding their credentials and API keys, and for all activity under their account.

4. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in compliance with these Terms.

4.1 Client Obligations

Clients shall:

  • Initiate verification or background checks only where Client has a lawful basis and have given the user any legally required notice and obtained any required consent or authorization.
  • Comply with all applicable laws, including the FCRA, EEOC guidance, anti-discrimination, “ban-the-box,” data-protection, and biometric-privacy laws.
  • Not use the Trust Score or Verification Results as the sole basis for an adverse decision where the law requires individualized, human review, and follow all required adverse-action procedures.
  • Not use the Service to unlawfully discriminate against, profile, or surveil any individual.

4.2 User Obligations

Users shall:

  • Provide your own genuine identity and authentic, unaltered government-issued documents.
  • Not submit forged, stolen, or borrowed identity documents, or impersonate another person.
  • Not use deepfakes, synthetic or pre-recorded media, virtual cameras, proxy interviewees, or other means to defeat or deceive the verification or integrity analysis.
  • Not use VPNs, proxies, or other tools to mask your location or device in order to circumvent checks.

4.3 General Prohibitions

users and Clients shall not:

  • Reverse-engineer, decompile, or attempt to extract source code, model weights, scoring logic, or detection thresholds.
  • Probe, attack, or attempt to evade the platform’s security, fraud, or AI-detection systems.
  • Scrape, bulk-extract, or programmatically harvest data or outputs except through authorized API use.
  • Use the Service or its outputs to build or train a competing identity-verification, trust-scoring, or fraud-detection product.

5. User Consent and Biometric Authorization

Identity verification involves processing government IDs and facial biometric data. Before biometric processing begins, the user is asked to provide explicit, informed consent. By proceeding, the user consents to this processing as described in our Data Privacy Statement. Clients are responsible for ensuring that any additional notices or consents required in their jurisdiction are also provided.

6. Intellectual Property

User Inputs: users retain ownership of their own identity documents and the personal information they submit, and grant 909Cyber a limited license to process that data to provide the Service.

Verification Results: The Trust Score and Verification Results are generated by the Service’s proprietary methodology. 909Cyber retains all right, title, and interest in the Service, including its scoring models, methodology, and the Verification Results, and grants Client a limited, non-transferable license to use the Verification Results corresponding to Client’s Sessions for its internal hiring and trust decisions. Unlike a generative content tool, outputs of the Service are risk signals owned by 909Cytber, not works made for hire, nor owned or assigned to Client. The Trust Score is retained by 909Cyber, but none of the 

Portable Identity: Verification Results and “Trusted” status records used for Portable Identity are owned and managed by 909Cyber and are shared only with user consent.

7. Disclaimers and Limitations (Trust Score and AI)

Identity verification and AI-based integrity analysis are probabilistic. Accordingly:

  • Risk signal, not a verdict: The Trust Score is a probabilistic risk indicator. It is not a determination of any person’s honesty, guilt, eligibility, or suitability for employment, and should not be treated as conclusive.
  • “As-Is” provision: Verification Results are provided on an “as-is” and “as-available” basis, without warranties of accuracy, reliability, or completeness.
  • False positives and negatives: Identity matching and deepfake/cheating detection may produce errors in both directions; no detection method is infallible.
  • Third-party data: Background and identity data are sourced from third parties (e.g., Onfido, Certn); 909Cyber does not guarantee their accuracy, and disputes follow the applicable FCRA or partner process.
  • Client responsibility: Clients are solely responsible for reviewing Verification Results, applying human judgment, and for all hiring and other decisions. The Services is not a substitute for legal or professional advice and accepts no liability for decisions made using the Service.

8. Client Compliance Responsibilities

As a condition of use, Clients agree to obtain all required candidate consents and disclosures; follow FCRA pre- and post-adverse-action procedures where background checks are used; comply with EEOC, anti-discrimination, biometric, and data-protection laws; and ensure a qualified human reviews Verification Results before taking any significant action.

9. Subscriptions, Credits, Billing, and Cancellation

9.1 Pricing Models. The Service is offered in two models: (a) Credits — pay-as-you-go for lower-volume use; and (b) Subscriptions — monthly or annual tiers for higher-volume recruiters and enterprise platforms. Some Verification Results require paid third-party checks (e.g., Onfido, Certn) whose costs are consumed from Client’s Credits or included in Client’s plan as specified at purchase.

9.2 Fees and Payment. By selecting a plan or purchasing Credits, Client agree to pay all fees presented at checkout, plus applicable taxes. 909Cyber uses third-party payment processors (e.g., Stripe). Client must keep valid payment information on file and authorize us or our processor to charge it for amounts due.

9.3 Auto-Renewal. Subscriptions renew automatically at the end of each billing cycle unless cancelled before the renewal date. We will give advance notice of price changes, and you may cancel before a new rate applies.

9.4 Refunds. Because third-party verification checks incur real, non-recoverable costs once performed, fees and consumed Credits are non-refundable except where required by law. We do not provide prorated refunds for partial billing periods or unused features. If you cancel, you retain access to paid features until the end of the current cycle.

9.5 Cancellation. You may cancel at any time through your account dashboard or by contacting support@909Cyber.com. Cancellation takes effect at the end of the current paid period. Cancelling does not automatically delete your account or data; to delete data, see our Data Privacy Statement.

9.6 Usage Limits and Overage. Your plan may include limits on Sessions, checks, or API calls. If you exceed them, we may throttle or temporarily suspend new Sessions, or move you to usage-based overage billing if you have opted in. Using automated scripts to bypass limits is prohibited.

10. Suspension and Termination

We may suspend or terminate access for breach of these Terms, suspected fraud or abuse, non-payment, or where required by law. You may stop using the Service and cancel pursuant to Section 9.5, above.

11. Indemnification

Client agrees to indemnify and hold harmless 909Cyber against claims arising from its misuse of the Service, failure to obtain required consents or provide required notices, or decisions made using Verification Results in violation of applicable law.

12. Limitation of Liability

To the maximum extent permitted by law, 909Cyber will not be liable for indirect, incidental, special, consequential, or punitive damages, and our total aggregate liability arising from the Service and these Terms will not exceed the amounts you paid for the Service in the twelve (12) months preceding the claim. 

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules, and disputes will be resolved in the courts located there. 

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the platform or by email, and continued use after changes take effect constitutes acceptance.
